when you first heard the Judgment what was your immediate reaction disbelief why because it is so different
from what I thought would be an open and shut issue the judge said that the prosecution did not provide enough
evidence to prove that Oscar borus was guilty of murder do you agree no not at all Oscar allegedly heard a noise he
fetched his firearm and without much further Ado he fired four shots into a bathroom door behind which he believed
another human being was hiding she said that intention to shoot didn't necessarily mean intention to kill if
you fire four shots from a 9 mil into a closed space where there's another human
being you must foresee the possibility that you will grievously wound them and probably kill them it's a very powerful
handgun I can't see how she can escape the conclusion that he intended to kill somebody behind that toilet door so
she's made an error I think so it was always my view that premeditated murder was never going to
fly however the question of whether this was murder or culpable homicide was always the issue and I don't see
negligence in what he did I see a reckless disregard for taking the life of another
human being whether it be Riva or somebody else do you think Oscar borus got away with murder well he hasn't got
away with it yet we need to see what happens next but as we stand at the moment Oscar is guilty only of the the
negligent killing of Riva so you know Americans watching this seeing this verdict having their own views on it
what what will should they come away with I don't think the American audience watching this will be impressed with the
standard of our Judiciary here based on this case it's not going to be a great boost for South African
judicial prowess in the World At Large in my view what do you think is the expectation regarding the prosecution do
they have grounds to appeal and should they I think that if they have half a chance they will appeal and if they have
half a chance I believe they should appeal because I don't think that this should be a judgment this should be a
allowed to stand
