On September 10, 2026, defense attorney Kevin Reddington filed a renewed Rule 25 motion asking Judge William Sullivan to enter findings of not guilty by reason of lack of criminal responsibility for Lindsay Clancy on every indictment against her.
The filing follows the September 4, 2026, mistrial at Plymouth Superior Court in Plymouth, Massachusetts. The jury reportedly deadlocked 11–1, with 11 jurors prepared to find Lindsay Clancy not guilty by reason of lack of criminal responsibility and one juror opposed.
Lindsay Clancy is charged in connection with the January 24, 2023, deaths of her children ,Cora Clancy, Dawson Clancy, and Callan Clancy, at the family’s home in Duxbury, Massachusetts. Her defense argues that prosecutors did not present sufficient evidence to prove that she could appreciate the wrongfulness of her conduct at the time, and that her ability to perform routine tasks did not establish criminal responsibility.
Kevin Reddington has asked for the motion to be considered at a court conference scheduled for September 29, 2026. If Judge William Sullivan grants the motion, it would constitute an acquittal and prevent Lindsay Clancy from being retried on the same indictments. If the motion is denied, another trial or a different resolution could follow.
