Miranda is now in it's there a 50th Anniversary it was 1966 50 years ago and over the years psychologists have done a
lot of research on Miranda comprehension and appreciation of those rights and people's willingness to invoke them and
it is clear that there are certain classes of people that lack comprehension sufficient comprehension
which is enough to make you wonder if they have a when they wave their rights is that a knowing and intelligent and
voluntary waiver it's clear that kids for example young adolescents don't fully comprehend their rights and it's
also clear that Miranda rights you think you know the wordage they vary from state to state to state and then there's
another interesting fact there is a fifth prong I mean you have the right to remain silent anything you say can be
used against you you have a right to an attorney if you can't afford an attorney
will give you one those are the four everybody's familiar with when I ask lay people if you sign your waiver of
Miranda rights they read you your rights say yeah I'm willing to talk and you sign your waiver
if things start to get bad later can you reinvoke people don't know the answer to
that question the answer is yes you can reinvoke your rights at any time that is
embedded in the opinion itself I think the problematic issue with Miranda aside from once we get past
people with limited abilities and and children the problem here is not that people don't comprehend those rights
it's that people who are innocent don't think they need them they understand what the rights are they
just don't think it applies to them because they didn't do anything wrong
